sorry i hate to bust your bubble but nothing beats a burm.......lol
I've kept several burms in the past and they are incredible pythons, i give big props to them...... but their just not retics.
The Banana Clown is absolutely gorgeous, but I don't agree that it's worth over $100,000 ... if there is someone that would pay that for that animal, they must have an all day sucker on their forehead http://snakebytesforum.com/forum/Smileys/default/evil5.gif
I'm not trying to start anything here with you Neil, but I think that price is way over the top. Especially in today's market. I would price it closer to $50K, and even then everyone wants to do partial trades on high priced animals. I personally think the days of 6 figure animals is long gone.
But this is just my humble opinion, and what do I know ... http://snakebytesforum.com/forum/Smileys/default/fkr.gif

If it's a BANANA does any one have one of a BANANA CLOWN?

I dont believe that you would be subject to copyright laws as you are stating the source of the pictures, and not claiming them as your own. ;)

No, it doesn't really work like that... you're probably thinking of the GNU General Public License. As a copyright holder, you stipulate the terms, conditions and limitations. Meaning if i dont want it reproduced for the duration of the copyright- then too bad, you can't reproduce it. I know one or two of you are thinking... well, what about "Fair Use?" Fair Use is generally only strongly protected for SCHOLARLY purposes... (no, this thread doesn't count meatheads ;) )
Copyright Act of 1976, 17 U.S.C. § 107, reads:
Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—
1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
2) the nature of the copyrighted work;
3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4) the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
While these are not the only determining factors, and generally the law leaves interpretation to the judge on a case by case basis- it begs the question- do you really have the time, money and patience to drag something like this through an appelate court if you get slammed in court?
More specifically in Campbell v. Acuff-Rose Music, Inc. 510 U.S. 569 it was shown that "Fair Use" is an excusive defense- meaning it is the defendant's responsibility to PROVE that the manner in which the material(s) were used fall under the protective umbrella of "Fair Use."
I can go on and on and on if you'd really like, and provide an exhaustive argument if need be... but i think you get my point. :D

Dude you are talking in a language I don't understand [ROFLMAO]
But I think it makes sense.... You can only use those images for scholarly purposes, this doesen't count as one, so the images are not allowed, right?

Ok, i was curious what RDR'd TOS were and went to the RDR website... and at the bottom of the page, it says "© 2006 Ralph Davis Reptiles. All Rights Reserved." which means (technically) reposting these images is against the law, and likewise I have removed them. If you get permission from ralph davis to repost them as you please, then all is well, and you (or whomever) are welcome to repost them. Otherwise, I have to delete them on sight... this goes for pretty much any material like that, not just RDR... if you or anyone else ever see anything like that on any of the forums I mod, please notify me or one of the other mods immediately to have the material reviewed and removed if necessary. Thanks!

no prob... alot of breeders are pretty guarded about their pics... usually because there are just way too many scammers out there... its almost always acceptable to provide a link as you just did, or tell people go to www.whateverthehell.com and click on main, then pics, then boas (or whatever.) In this way you remove any question of copyright violation. One exception i know that is generally allowed is you can post stuff from bob clark (within reason) b/c Mike and Bob are friends.
